Aug. 14, 2006. “As we discuss below, should this case get dragged out by interminable motions or otherwise, the decisions regarding the best interests of New York State may simply be made in Washington, D.C. * * * *  it seems clear that this case must be run efficiently, especially in light of the recent National Electric Transmission Congestion Study (US Dept. of Energy, August, 2006) concerning the designation of a transmission corridor of national interest in New York. Our failure to do
so may result in the decision being preempted by the federal government.”
